Riding your motorcycle when there is ice on the road

Facts of the case

Mr H* suffered an accident when his bike slipped as a result of ice on the road. It was a cold, December day and the ice was caused by a burst water pipe on the road-side leaking water onto the road.

The local water authority was attending to the leak however they had failed to close the road or adequately grit the road to reduce the risk of an accident occurring.

The water company argued that responsibility for the safety of the road remained with the local authority and that they should have gritted the road.

What action did Sorrymate take?
